Help prevent identity theft

Criminals are not only filing bogus tax returns using other people’s identification, they are also stealing the “look” of the IRS to phish for additional financial information from taxpayers.

The IRS has made numerous announcements in the past to help protect taxpayers from these scams. It repeats the message that it will never use an e-mail, text message, or social media to initiate a contact about your tax information.

If you receive what looks like an official IRS e-mail, you should forward it to phishing@irs.gov. Do not reply to the sender, and do not open any attachments.

IRS issues “state of celebration” rule for same-sex marriages

The IRS recently issued a ruling that will treat same-sex married couples the same as opposite-sex couples for federal tax purposes as long as the marriage occurred in a jurisdiction that recognizes same-sex marriages as legal. This ruling, known as the “state of celebration” rule means same-sex couples can live anywhere they like, and they’ll be considered married for tax purposes as long as the marriage itself occurred where it was legal.

Review your tax deductions for 2013 while there’s still time to manage them for a lower tax bill this year. The standard deduction for 2013 is $12,200 for married couples filing a joint return and $6,100 for single taxpayers. If your deductions are close to the threshold, consider accelerating deductible expenses. For example, you can add sales tax paid on a new vehicle to the IRS standard amount when claiming the itemized deduction for state and local sales tax.

Take an energy credit

The IRS reminds taxpayers that certain energy credits are still available. If you haven’t already taken advantage of them, this may be the year to make energy-efficient improvements to your home. You may be entitled to a credit of 10% of the cost of certain energy-saving improvements such as insulation, windows, doors, skylights, and roofs. The credit has a maximum lifetime limit of $500; the credit for windows is limited to $200. Not all energy improvements qualify, the IRS cautions taxpayers, so be sure you have the manufacturer’s credit certification statement (usually available with the product’s packaging or on the manufacturer’s website).

IRS extends deadline for farmers and fishermen

The IRS had to delay the start of this year’s tax filing season until it completed programming changes made necessary by the late passage of the “American Taxpayer Relief Act of 2012” (signed into law on January 2, 2013).

Normally, farmers and fishermen are not required to make quarterly estimated tax payments if they file their tax return and pay taxes due by March 1 of the following year. The filing delay created by the new law meant that several tax forms needed by these taxpayers would not be ready on time.

As a result, the IRS has announced an extension of the March 1 filing deadline for farmers and fishermen to April 15.

The filing extension will apply to all farmers and fishermen, not just to those who use late-released IRS forms.

To qualify as a farmer or fisherman for 2012, at least two-thirds of the taxpayer’s gross income for 2011 or 2012 must have come from farming or fishing.

Forgiven debt can be taxed as income

With the recent economic downturn experienced by many taxpayers, there is a tax concept that is very important: cancellation of debt. You would think that the cancellation of debt by a credit card company or mortgage company would be a good thing for the taxpayer. And it can be, but it can also be considered taxable income by the IRS. Here is a quick review of various debt cancellation situations.

* Consumer debt. If you have gone through some type of credit “workout” program on consumer debt, it’s likely that some of your debt has been cancelled. If that is the case, be prepared to receive IRS Form 1099-C representing the amount of debt cancelled. The IRS considers that amount taxable income to you, and they expect to see it reported on your tax return. The exception is if you file for bankruptcy. With bankruptcy, generally the debt cancelled is not taxable.

Even if you are not legally bankrupt, you might be technically insolvent (where your liabilities exceed your assets). If this is the case, you can exclude your debt cancellation income by reporting your financial condition and filing IRS Form 982 with your tax return.

* Primary home. If your home is “short” sold or foreclosed and the lender receives less than the total amount of the outstanding loan, you can also expect that amount of debt cancellation to be reported to you and the IRS. But special rules allow you to exclude up to $2 million in cancellation income in many circumstances. You will again need to complete IRS Form 982, but the exclusion from taxable income brought about by the debt cancellation on your primary residence is incredibly liberal. So make sure to take advantage of these rules should they apply to you.

* Second home, rental property, investment property, business property. The rules for debt cancellation on second homes, rental property, and investment or business property can be extremely complicated. Generally speaking, the new laws that cover debt cancellation don’t apply to these properties, and the IRS considers any debt cancellation to be taxable income. Nevertheless, given your cost of these properties, your financial condition, and the amount of debt cancelled, it’s still possible to have this debt cancellation income taxed at a preferred capital gains rate, or even considered not taxable at all.

Be aware that many of the special debt cancellation provisions are set to expire at the end of 2012. If you’re unsure as to how debt cancellation affects you, contact our office to review your situation and determine how much, if any, cancelled debt will be taxable income to you.

Don’t overlook tax-saving deductions

If you itemize deductions on your tax return, every additional deduction you find will save you money. In the past, higher-income taxpayers had their itemized deductions limited. Effective for 2010, 2011, and 2012 tax returns, there is no income-based reduction in total itemized deductions. That may give higher-income taxpayers another reason to track their deductions carefully.

Here’s a sampling of often-missed deductions.

* Disaster losses not reimbursed by insurance.

* Job-hunting travel and telephone expenses.

* Employment agency and job counseling fees.

* Costs for resume preparation.

* Union or professional association dues.

* Specialized work clothing or small tools used at work.

* Points paid by you on a new home loan.

* Home mortgage points paid by a seller on your behalf.

* Points paid on refinancing your home mortgage (deductible pro rata over the life of the loan).

* Remaining undeducted points on a prior refinancing when you refinance again.

* Your actual expenses or 14¢ a mile for driving in doing charitable work.

* Gambling losses, but only to the extent of your winnings.

* Fees paid for the preparation of your tax return.

Who qualifies as your dependent? Here’s the tax answer

Who depends on you? When the people counting on you for support are qualifying children or relatives, you may be eligible for a dependency exemption of $3,650 on your 2010 federal income tax return ($3,700 on 2011 returns).

Not sure who meets the definition? Consider these facts.

* Dependents cannot have dependents. The “dependent taxpayer” test prevents you from claiming a dependent when someone else claims you on their return. Put another way, you can only claim a dependent if you yourself are not one.

* The tax code gives a definition of a qualifying child. Generally, a qualifying child must not have filed a joint return. In addition, the child must be younger than you are.

* Divorced or separated parents need a signed release to claim an exemption. If you’re a noncustodial parent who wants to claim a dependency deduction for your child in 2010, you must attach Form 8332 to your federal income tax return. As a general rule, copies of divorce decrees or separation agreements are no longer acceptable.

* Qualifying relatives can include family members who do not live with you. Do you support a parent in a nursing home or another state? You may be able to claim a dependency exemption as long as your loved one’s gross income is less than $3,650 for 2010 ($3,700 for 2011), and you provide more than half the total support.

If other family members pitch in to help but no one individually furnishes more than half of your loved one’s total support, you can still benefit. A “Multiple Support Declaration” (Form 2120) lets you decide who claims the exemption.

Delayed tax returns can be filed starting February 14

Taxpayers who itemize deductions, claim the educator expense deduction, or claim a deduction for tuition and fees were told by the IRS not to file their 2010 returns until the IRS had reprogrammed its computers to handle these late-2010 changes.

The IRS has just announced the filing start date for these returns: February 14, 2011. On that date, the IRS will begin processing paper and e-filed returns claiming any of these deductions.

IRS eliminates paper coupons for tax deposits

In December 2010, the IRS announced new regulations that effective January 1, 2011, all Federal Tax Deposits must be made using the Electronic Federal Tax Payment System (EFTPS).

The paper coupon system will no longer be available. However, taxpayers who owe minimal amounts may still send their payment along with their tax return. For example, a Form 941 filer that owes less than $2,500 can submit payment with the return or choose to use EFTPS. The minimal amount that permits payment with a return varies with the type of tax.
